A notary public, often simply referred to as a notary, is an official who acts as an unbiased witness to the signing of important documents. Notaries, typically appointed by a state government officer, help to deter fraud and ensure that signers willingly enter into agreements. Notaries are known as “ministerial” officials, since they follow a specific set of rules during the notarization process.
A proper notarization process begins with the an in-person appearance by the parties signing a document. The notary then checks the documents to be signed for any issues or discrepancies prior to identifying the signers. The identification process can be completed in one of three ways; the notary personally knows the signers; the signers present identity documents; or witnesses are present to vouch for the signers’ identities. Lastly, after ensuring that the parties are signing willingly, notaries complete a journal entry to document the signing, and complete a certificate with an official seal to formalize the notarization.
